UP&UPC: off we go!
At last, the new patent system based on the European Patent with Unitary Effect (UP) and the Unified Patent Court (UPC) starts today. Studio Torta is prepared to face this new challenge: 31 of our European patent attorneys are qualified as European Patent Litigators, and we have collaborations with the best European IP lawyers to provide the most effective legal assistance before all the venues of the new court.
During the Sunrise Period Sunrise Period we filed about 3,000 opt-out applications for all those who chose to protect their European Patents from a centralized attack before the new court.
Only time will tell whether the new system will meet the many expectations of efficiency, justice and balance, which are very important requirements for any industrial property system for the benefit of an open market that rewards innovation.
