Extension of the terms of validity for industrial property rights before the Italian Patent and Trademark Office
Law no. 27 of 24 April 2020, which converted into law – with some modifications – Law Decree no. 18 of 17 March 2020, further modifies the terms of validity of industrial property rights: rights expiring between 31 January 2020 and 31 July 2020 – no longer 15 May – maintain their validity for ninety days following the declaration of the end of the emergency status. After this date, it is up to the interested party who intends to extend the duration of an industrial property right to take action, in order to keep it in force or have it renewed at the end of said period.
As a reminder, all terms pending before the Italian Patent and Trademark Office on 23 February 2020, or starting after this date, have been suspended until 15 May 2020 and are therefore extended by a period corresponding to that of the suspension.
